Terms of Service

1. Acceptance

By accessing or using the CareDeck platform ("Service") you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of a care home or organisation, you represent that you have the authority to bind that organisation to these Terms.

2. The Service

CareDeck provides care management and CQC compliance software for UK care homes. The Service is provided on a subscription basis as described on our Pricing page. We reserve the right to modify features with reasonable notice.

3. Your account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at security@caredeck.co.uk if you become aware of any unauthorised access.

4. Acceptable use

You agree not to:

  • Use the Service to process data for purposes other than the management of residents in your care home.
  • Attempt to reverse-engineer, scrape, or extract data or source code from the platform.
  • Share account credentials with parties outside your organisation.
  • Use the Service in any way that violates applicable law or regulation.
  • Attempt to circumvent the role-based access control or permission system.

5. Data and privacy

You are the data controller for all resident data entered into the Service. CareDeck acts as your data processor under UK GDPR Article 28. Our full data processing practices are governed by our Privacy Policy and a Data Processing Agreement (available on request).

6. Payment and billing

Subscriptions are billed monthly in advance in GBP, exclusive of VAT. Payment is processed securely via Stripe. You may cancel at any time; cancellation takes effect at the end of the current billing period. We do not offer prorated refunds for partial months.

7. Uptime and support

We target 99.9% monthly uptime for the Service and will communicate any planned maintenance in advance. Support is provided by email Monday–Friday, 8 am–6 pm GMT. Enterprise plans include additional SLA commitments.

8. Intellectual property

CareDeck and all related software, trademarks, and intellectual property remain the property of CareDeck Ltd. You are granted a limited, non-exclusive, non-transferable licence to use the Service during the term of your subscription.

9. Limitation of liability

To the maximum extent permitted by law, CareDeck's total liability for any claim arising from these Terms is limited to the subscription fees paid by you in the 12 months immediately preceding the claim. CareDeck is not liable for indirect, incidental, or consequential losses of any kind.

10. Termination

Either party may terminate the subscription at any time. CareDeck may terminate immediately for material breach of these Terms. Upon termination, you may request an export of your data; we will hold data for 30 days to facilitate this, after which it will be securely deleted.

11. Governing law

These Terms are governed by the laws of England and Wales. Any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes

We will notify you of material changes to these Terms by email at least 30 days in advance. Continued use of the Service after that date constitutes acceptance of the revised Terms.
